1.2 Emancipas, LLC (“we,” “us,” “our,” “Emancipas”) is the owner of the Emancipas mobile application (“Emancipas” or the “App”). Emancipas is a mobile application that enables you to partner with a friend and hold each other accountable for the amount of time you spend on apps you are trying to avoid on your phone. Some features require a premium subscription to utilize (the “Service”).

2. Privacy Statement

2.1 This Privacy Policy explains how we collect, use, maintain and disclose your information. This includes information that could be used to identify a specific user (“Personal Information”), and other information that does not constitute Personal Information (“Non-Personal Information”) that is collected from you while using our Service. We take the privacy of your Personal Information seriously.

3. Purpose of Our Policy

3.1 We adopted this Privacy Policy to ensure that we have standards in place to protect the Personal and Non-Personal Information that we may collect from you. We published this Privacy Policy to make it easy for you to understand what Personal Information we collect and store, why we do so, how we receive and/or obtain that information, and the rights you have over your information in our possession.

4. Consent

4.1 When you use our Service, you consent to our collection, use, disclosure, transfer and storage/retention of any Personal and Non-Personal Information received by us as a result of your use, all in accordance with this Privacy Policy.

5. Children’s Privacy

5.1 We do not knowingly collect data from or market to children under 13 years of age or the equivalent age as specified by law in your jurisdiction. By using the Services, you represent that you are at least 13 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If you believe that we have collected personal information from a child under 13 or the equivalent age as specified by law in your jurisdiction, please contact us at contact@emancipas.com and we will work to delete such data from our records.

6. Information We Collect

6.1 We collect minimal personal information that you voluntarily provide to us when you register for the Service or contact us. The personal information we collect may include:

  • First Name

  • Email Addresses

  • Phone Numbers

6.2 Application Data. We may collect the following information if you choose to provide us with access or permission:

  • Mobile Device Access. We may request access to your mobile device’s Screen Time data and other features necessary for the Service to function. This data always remains on your device and we cannot access it.

  • Push Notifications. We may request to send you push notifications regarding your account or features of the application.

6.3 Payment Data. We may collect data necessary to process your payment if you choose to make purchases. All payment data is handled and stored by Apple Payments Inc. You may find their privacy notice at: https://www.apple.com/legal/applepayments/privacy-notice/.

6.4 Sensitive Information. We do not process any sensitive personal information such as racial or ethnic origins, sexual orientation, or religious beliefs.

6.5 All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

7. How We Use Your Information

7.1 We process your information for the following purposes:

  • To facilitate account creation and authentication and manage user accounts

  • To deliver and facilitate delivery of services to you

  • To enable user-to-user communications between accountability partners

  • To communicate with you about your account and our services

  • For security and fraud prevention

  • To comply with legal obligations

  • To save or protect an individual’s vital interest when necessary

7.2 We process your information only when we have a valid legal reason to do so and will not use your information for any other purposes without your explicit consent.

8. Information Sharing and Disclosure

8.1 Other Users. Your friend/accountability partner will be able to view your first name, phone number, and a description of your activities. Your friend will also be able to communicate with you within our services. Other users will be able to view your first name if you share your Friend Code with them.

8.2 Service Providers. We utilize Google Firebase services to store and process your information securely, including:

  • Firebase Authentication

  • Firestore Database

  • Google Cloud Functions

  • Firebase Cloud Messaging

8.3 Business Transfers. We may share or transfer your information in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

8.4 Legal Requirements. We may disclose your information when required by law or to protect rights, property, or personal safety.

8.5 We do not sell, trade, or rent your personal information to third parties.

9. International Data Transfers

9.1 Our servers are located in Europe and most processing occurs there as well. However, a few Google Firebase services such as Authentication may process and store your data in the United States. If you are accessing our Services from outside of Europe or the United States, please be aware that your information may be transferred to, stored by, and processed in these locations.

9.2 We have implemented appropriate safeguards for international data transfers, including using the European Commission’s Standard Contractual Clauses. Our Data Processing Agreements are available at: https://firebase.google.com/terms/data-processing-terms.

10. Data Retention

10.1 We keep your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required by law. We will only keep your personal information for as long as you have an account with us.

10.2 When we no longer need to process your personal information, we will either delete it, anonymize it, or securely store it until deletion is possible.

11. Data Security

11.1 We have implemented appropriate technical and organizational security measures designed to protect your personal information. However, no electronic transmission over the Internet can be guaranteed to be 100% secure, so we cannot promise that hackers or other unauthorized third parties will not be able to access or misuse your information.

11.2 You should only access the Services within a secure environment.

12. Your Privacy Rights

12.1 Depending on your location, you may have certain rights regarding your personal information, including:

  • Right to access and obtain a copy of your personal information

  • Right to request correction or deletion of your personal information

  • Right to restrict the processing of your personal information

  • Right to data portability

  • Right to object to processing

  • Right not to be subject to automated decision-making

12.2 Account Management. You can review or change your account information by logging into your account settings. You can also delete your account from these settings or by contacting us. This action will delete your account and information from our active databases. However, we may retain some information in our files if it is required to comply to applicable legal requirements.

12.3 Withdrawing Consent. You can withdraw your consent at any time by contacting us. This will not affect the lawfulness of processing before withdrawal.

13. Do-Not-Track Features

13.1 We do not currently respond to Do-Not-Track browser signals on our website as no uniform technology standard has been finalized. If a standard is adopted that we must follow, we will inform you in a revised Privacy Policy. Our app does not monitor or collect your online browsing activities.

14. State-Specific Privacy Rights

United States Residents

14.1 If you are a resident of certain US states (including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia), you may have additional rights including:

  • Right to know whether we are processing your personal data

  • Right to access your personal data

  • Right to correct inaccuracies in your personal data

  • Right to request deletion of your personal data

  • Right to obtain a copy of your personal data

  • Right to non-discrimination for exercising your rights

14.2 Categories of Personal Information We Collect:

  • Identifiers (name, phone number, email address)

  • Personal information as defined in California Customer Records statute

14.3 We have not disclosed, sold, or shared any personal information to third parties for business or commercial purposes in the preceding 12 months, and we will not sell or share personal information in the future.

 

International Residents

14.4 EU/UK/Switzerland Residents: You have rights under GDPR including the right to complain to your data protection authority if you believe we are unlawfully processing your personal information. GDPR and UK GDPR require us to explain the valid legal basis we rely on to process your personal information. We rely on the following legal bases:

  • Consent. If you have given us permission, we may process your personal information for a specific purpose. You may withdraw this consent at any time.

  • Performance of a Contract. If we believe it necessary to process your personal information in order to fulfill out contractual duties to you such as providing our Services, we may process your personal information.

  • Legal Obligations. If we believe it is necessary to process your information in order to comply to legal obligations, we may process your personal information.

14.5 Canada: We may process your information with your express or implied consent, or in certain exceptional cases permitted by law.

14.6 Australia/New Zealand: We process your information under Australia’s Privacy Act 1988 and New Zealand’s Privacy Act 2020. You may submit a complaint to your data protection authority if you believe we are unlawfully processing your personal information.

14.7 Republic of South Africa: You may submit a complaint to your data protection authority if you believe we are unlawfully processing your personal information.

15.1 We may update this Privacy Policy from time to time. The updated version will be indicated by an updated date at the top. If we make material changes, we may notify you by posting a notice or sending you a notification. We encourage you to review this Privacy Policy frequently.
